Retirement To Keep Biernat From Presiding Over 2nd Michael George Trial

Here's a great catch by the Johnstown, Pennsylvania newspaper in the ongoing saga of Michael George, the former prominent Pennsylvania retailer and convention organizer currently awaiting a second trial for the 1990 of his then-wife Barbara in their Michigan comics store. The second trial is now expected to be heard by a judge other than James Biernat because Biernat is set to retire. Biernat presided over the initial conviction but also allowed for the second trial based on the way the prosecutor's office handled certain witnesses. A new judge, which will be assigned randomly, could have a huge impact on how the new trial is conducted.

Biernat will preside over an evidentiary hearing scheduled for December 13 on one of those witness matters, the request for which pushed the second trial once believed for late 2010 into at least 2011.
